The
petitioner filed an appeal before the first respondent under Section 18 of the
Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal)
Act, 2013. However, this appeal was returned by the first respondent vide
Ext.P4 stating that the first respondent is not the appellate authority. The
petitioner refers to Ext.P5 notification issued under Section 2 of
the Industrial Employment (Standing Orders) Act, 1946. This shows that the
first respondent is the appellate authority. In that view of the matter, the
impugned order is set aside. The first respondent is directed to dispose of the
appeal, at any rate, within a period of two months after hearing all concerned.
The writ petition is
disposed of as above. No costs.
